The website www.mafiartes.pt is owned and operated by Traços Dispersos, Lda, tax identification number 518344495, with its registered office at Rua Manuel Castelão nº1, 1º Esq, 2640-447 Mafra, Portugal, hereinafter referred to as "MafiArtes".
These Terms and Conditions (the "Terms") govern the use of the MafiArtes website (the "Website") by its users (the "User") and regulate the relationship between the User and our brand ("we", "us", or "our").
Please read these Terms carefully, as they affect your rights and obligations under applicable law.
By ordering any of our products or services, the User agrees to be bound by these Terms.

We do not carry out credit scoring or creditworthiness assessments, and your credit rating will not be affected.

8. Orders
All orders are subject to acceptance and availability.
Should any ordered products be unavailable, the User will be notified by email (or by another contact method if no email address has been provided) and may choose either to wait until the product becomes available or to cancel the order.
Any order placed by the User shall be treated as an offer to purchase our products or services. We reserve the right to refuse any such offer at our sole discretion.
The User acknowledges that the automated order confirmation does not constitute acceptance of the order. A contract between us and the User will only be formed when:
(i) payment for the order has been successfully received; and/or
(ii) the products have been dispatched or the services have commenced, whichever occurs later, at which time an email confirming dispatch ("Dispatch Confirmation") will be sent.
The contract shall relate only to the products or services whose dispatch has been confirmed in the Dispatch Confirmation.
We take all reasonable care to ensure that order and payment details remain secure. However, in the absence of negligence on our part, we shall not be liable for any loss suffered as a result of unauthorised access by a third party to information provided by the User when accessing or ordering through the Website.
Products sold through the Website are intended for end consumers only and are not for resale or distribution. We reserve the right to cancel orders and suspend accounts where we reasonably believe that products are being purchased in breach of this provision.
MafiArtes currently offers delivery to the customer's address as its delivery method. Shipping costs are displayed during checkout, and the User assumes responsibility for the products once they have been delivered to the address provided in the order.
We shall not be liable where an incorrect delivery address is supplied or where the User fails to collect the products from the designated delivery address.
However, the risk of loss or damage to the products shall only pass to the User upon delivery to the specified delivery address.
The shipping times, costs, and delivery conditions are set out in our Shipping and Delivery Policy.
9. Right of Return, Exchange and Cancellation
As provided by applicable law, MafiArtes accepts returns and exchanges of products, with the exception of personalised items, provided that they have not been used and remain in the same condition in which they were originally supplied.
Requests for returns or exchanges must be submitted clearly and unequivocally via:

- The contact form available on the Website;
within a maximum period of 14 days from the date of receipt of the order.
Upon receipt of the returned product(s), a thorough inspection will be carried out. The return or exchange will only be accepted if the following conditions are met:
a) The product(s) show no signs of use or handling;
b) The product(s) retain their original characteristics and all labels and tags remain intact;
c) The product(s) are complete and returned together with all materials originally supplied with the order.
Any return or exchange request must include the order number and, where applicable, evidence of the defect or non-conformity.
Refunds will be processed using the original payment method used for the purchase within a maximum period of 14 business days, unless otherwise agreed with the customer.
Shipping costs are non-refundable and remain the responsibility of the customer.
Where a return results from a defective product or any other lack of conformity, MafiArtes will bear the costs of the original shipping charges as well as any costs associated with the return or exchange process.
If a returned product does not meet the eligibility requirements described above, the customer will be informed that the request has been rejected. The item(s) will then be returned to the address provided in the original order, and all associated costs will be borne by the customer.
10. Prices and Payment
All prices displayed on the Website include VAT at the applicable legal rate.
Prices are correct at the time of publication. However, we reserve the right to change prices at any time without prior notice, except where such changes affect orders for which a Dispatch Confirmation has already been issued.
In the unlikely event that a pricing error is identified before we accept an order, we shall not be obliged to supply the products at the incorrect price displayed.
If a pricing error is discovered, the User will be informed as soon as possible and given the option either to proceed with the order at the correct price or to cancel it.
If the User chooses to cancel and payment has already been made (provided the goods have not yet been dispatched), a full refund will be issued.
The User confirms that payment will be made using one of the payment methods made available by MafiArtes, including:
- Multibanco
- MB WAY
- Credit Card
- Google Pay
- Apple Pay
- PayPal
We reserve the right to await payment for up to 24 hours. If payment is unsuccessful, the User will be notified via the email address provided.
Should the User not wish us to attempt to process payment again, the order should be cancelled before further processing takes place.
Promotional codes may only be used in accordance with the specific terms and conditions under which they were issued. These terms may include eligibility requirements, minimum order values, maximum discounts, and other restrictions.
We reserve the right to reject or cancel any order that does not comply with the applicable promotional code conditions, even where payment has already been authorised.
In the event of any inconsistency between these Terms and the terms governing a promotional code, the promotional code terms shall prevail.
Copies of promotional code terms and conditions may be requested via email or telephone.
11. Intellectual Property
All content contained on the Website is protected by copyright, trademarks, database rights, and other intellectual property rights.
The User acknowledges that all material and content made available through the Website shall remain our property or that of our licensors.
You may:

- Store content electronically on a local storage device;
- Print one copy of content for personal, non-commercial use;
provided that all copyright notices and proprietary notices remain intact.

Supply of Products and Services
If we fail to comply with these Terms, we shall only be liable for losses suffered by the User that are a foreseeable consequence of our breach.

- Fraud or fraudulent misrepresentation;
- Breach of statutory obligations that cannot legally be excluded;
- Defective products under applicable consumer protection laws;

The User acknowledges that we cannot guarantee the security or privacy of the Website or of information transmitted through it.

These Terms constitute the entire agreement between MafiArtes and the User regarding the use of the Website and supersede any previous agreements, understandings, or arrangements relating to the same subject matter.
16. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Portugal.
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Portuguese courts.
17. Reviews and User Content
By submitting a review, comment, testimonial, or any other content, the User grants MafiArtes a non-exclusive, royalty-free, worldwide right to:
- Publish;
- Translate;
- Adapt;
- Reproduce;
- Distribute;
- Display; and
- Otherwise use such content
through any media or communication channel associated with MafiArtes.
The User also grants MafiArtes the right to use the name provided in connection with such content if we choose to do so.
The User agrees to waive any right to be identified as the author of such content and any right to object to its publication, adaptation, or use by MafiArtes, to the extent permitted by applicable law.
Use of Artificial Intelligence
At MafiArtes, we use Artificial Intelligence tools to present our products realistically through virtual models and visual representations.
We do so in order to provide a better visual experience for unique and handcrafted pieces, while maintaining our commitment that the representation of each item remains faithful to the original product.
